Overview

Mr. Martin is a licensed insurance adjuster and lawyer whose practice is focused on insurance related issues, including coverage issues, insurer bad faith liability, and insurance agent and broker professional liability. He enjoys an extensive ADR practice, extending over two decades, with experience handling a wide range of disputes from general torts to complex contract and professional liability issues. Mr. Martin is also an experienced adoption lawyer providing adoption services throughout the State of West Virginia.

In addition, Mr. Martin has been selected by his peers for inclusion in Best Lawyers in America ® for Arbitration, Mediation, and Insurance Law from 2006 to the present and for Reinsurance Law from 2017 to the present.

Mr. Martin has fourteen years of insurance industry experience, during which he has worked as both a captive and independent insurance agent selling all lines of insurance including life, health, pension and investment products, as well as personal and commercial property and casualty insurance. He also worked as a sales and agency manager hiring, training and supervising insurance agents. In this capacity Mr. Martin had significant interaction with both underwriting and claims personnel on issues related to applications and claims submitted by agency customers. He is intimately familiar with both retail agent and agency operations, and he is equally knowledgeable about the operations of excess/surplus lines brokers and excess/surplus lines markets. During his twenty-eight years as a practicing lawyer, Mr. Martin has been hired on numerous occasions to directly adjust claims for both insurance companies as well as claimants.

Mediation And Arbitration Services

Mr. Martin enjoys an active and expanding practice as a mediator, arbitrator and facilitator in litigation matters, as well as in business disputes outside the litigation context. Mr. Martin has successfully handled disputed matters involving insurer bad faith, insurance agent conduct, general tort, legal and medical professional liability, employment practices, construction defects, products liability, and railroad issues, among others.

Adoptions Services

An experienced adoption lawyer serving the state of West Virginia, Mr. Martin represents family members and foster parents seeking to adopt children placed in their care, primarily through Child Protective Services and West Virginia Department of Health and Human Resources subsidized adoptions. Mr. Martin regularly serves as a Guardian ad litem in Circuit Court representing minor children in abuse and neglect and civil matters, and is in constant contact with Child Protective Services and West Virginia Department of Health and Human Resources personnel. As a result, he knows and understands the process and procedures as well as the issues that can, and do, arise in the adoption process.
